Release, Waiver, and Sworn Statement

Note that each participant must complete this agreement.


A. RELEASE

I, the PARTICIPANT or the PARENT or LEGAL GUARDIAN or the PARTICIPANT, age 17 or younger (hereinafter collectively referred to as “PARTICIPANT”), hereby waive, release, and grant to VITAS International Music Competition (hereinafter referred to as “VITAS”) and/or its assignees, any and all rights that I may have to any recordings, videography, and/or photographs made by or for the VITAS of any performance or event organized or sponsored by it. I understand and agree that by virtue of this waiver, release, and grant of rights, the VITAS will have the right to make full and unrestricted use of such recordings, videography and/or photographs, including without limitation, in advertisements, commercial ventures, and promotions and for the sale or lease of same, without any fee or other compensation owed to me.


B. WAIVER

I, the PARTICIPANT, fully and in good faith intending to be bound thereby, do hereby promise not to initiate any claim, lawsuit, or other legal action, pertaining to any action or omission by the VITAS relating directly or indirectly to the competition as to which application is herewith being made. This promise is made as a condition of the application, and in consideration for the VITAS’ processing and evaluation of the application. This promise constitutes an acceptance and agreement by the PARTICIPANT that, for example, decisions by competition jury are final and unappealable, and the physical spaces of the competition venues are reasonably safe and appropriate for their intended purposes. (However, this promise is not in any respect limited to the above two examples.) I intend that this promise be fully binding upon the PARTICIPANT, as well as upon heirs, successors, and assignees of the PARTICIPANT. This promise applies to the application process, the competitions, and all events under the purview of the VITAS International Music Competition and its associated activities and/or events.


C. SWORN STATEMENT

I, the PARTICIPANT, hereby certify that all recordings of the repertoire herein which I have submitted to VITAS International Music Competition for consideration have been performed and/or recorded by the participant completely from memory, without the use of musical scores, notes, or auxiliary musical notation of any kind. Furthermore, I, the PARTICIPANT, hereby affirm to the fact that the recording submitted with this application is a true and accurate representation of my performance.


D. GENERAL TERMS AND CONDITIONS

VITAS is not responsible for and shall not be held liable for (a) lost, late, delayed, damaged, incomplete, illegible, unintelligible, or misdirected entries; (b) telephone, electronic, hardware or software program, network, internet, or computer malfunctions, failures, or difficulties of any kind; (c) failed, incomplete, partial, garbled, or delayed computer transmissions; (d) any condition caused by events beyond the control of the VITAS that may cause the competition to be disrupted (i.e. weather complication, natural disasters etc.); (e) any printing or typographical errors in any materials associated with the competition; (f) any claims, suits, actions, liabilities, injuries, losses, or damages of any kind in connection with the competition or resulting from acceptance, possession, or use of any prizes and awards.
By entering this competition, each participant, parent or legal guardian (if participant is under 18 years of age as of the date of application) agrees to accept these rules and be bound by the decisions of VITAS, its jury and staff, which are final and binding in all matters.
Truthfulness: Any applicant who knowingly falsifies documentation, recording or gives false details for admittance to the competition will be barred from the competition.
